John Foster's Will, dated July 11, 1799

In the name of God, amen.

I, John Foster of Ross County, Northwestern Territory, being of sound and disposing mind and memory, and calculating on the absolute certainty of death, and willing to settle and dispose of that portion of earthly goods with which it has pleased divine goodness to bless me, do therefore make and ordain this present instrument of writing my last will and testament in manner and form following:

First, my desire is that my body should be decently buried and the expenses thereof paid of my personal estate.

Item. I give and bequeath to my son Lewis Foster of Bedford County, Pa. Two tracts of land lying and being in Aspewell Township in the said County of Bedford, one of which tracts contains ninety-nine and a half acres, and the other contains two hundred and forty acres or thereabouts, but be the same more or less as to both of said tracts. I also give to my son Lewis, one horse, his choice of the stock of horses I may possess at my decease, and also all my wearing apparel.

Item. I give and bequeath unto my son Thomas Foster one cow.

Item. I give and bequeath unto my son John one cow.

Item. I give and bequeath to my two sons, Benjamin and Joseph, and to my two daughter, Cassandra Chenowith and Rachel Chenowith all and singular that tract of land lying and being in the County of Ross, on the waters of Scioto River, and containing one thousand acres, it being the same that I purchased from Doctor Knight. The said land lies six or seven miles above the mouth of Darby's creek to be equally and fairly divided among them, my said to sons and daughter as aforesaid. I give and bequeath to my two sons, Benjamin and Joseph, a featherbed and furniture, and a cow each, viz, my son Benjamin a bed and furniture and one cow, and to my son Joseph a bed and furniture and one cow.

Item. I give and bequeath to my son Richard all and singular the tract of land I live on, on Scioto River in the Pee Pee Town bottom containing three hundred acres of land and also all the residue and remainder of my estate, whether real personal or mixed, to him and his heirs forever, he my son Richard paying all my just debts and funeral expenses.

And I hereby nominate and appoint my two sons Thomas and Richard my executors to this my last will and testament, in witness whereof I have herunto set my hand and seal this eleventh day of July 1799.

The following is taken from Record of Maryland Troops in the Continental Service during the War of the American Revolution, 1775-83:

FLYING CAMP

RESOLVES OF CONTINENTAL CONGRESS - 3 June, 1776

"Resolved unanimously, That a flying camp be immediately established in the middle colonies; and that it consist of 10000 men; to complete which number

Resolved, That the colony of Pennsylvania be requested to furnish of their militia 6000, Maryland, of their militia 3400, Delaware government, of their militia 600."

RESOLVES OF THE MARYLAND CONVENTION OF JUNE, 1776 - 25 June, 1776

"Resolved unanimously, That this province will furnish 3405 of its militia, to form a flying camp, and to act with the militia of Pennsylvania and the Delaware government in the middle department; that is to say, from this province to New York inclusive, according to the request of the Congress in their resolutions of the 3rd day of this instant June."

These companies were to serve within the said limits until 1 December, 1776, unless sooner discharged by Congress. None were to be compelled to serve out of said limits or beyond 1 December. They were to be arranged in 4 battalions and 1 company, each battalion consisting of 9 companies. Warrants were to be issued, by the President of the Convention, to the persons appointed by the Convention, to enroll the non-commissioned officers and privates. A captain was to enroll 30, a lieutenant 20, and an ensign 16 men. Enrollments, even if not completed, were to be returned to the Convention, or Council of Safety, by July 20th. If any enrollments were not complete, the Convention, or Council of Safety, could commission the persons to whom the warrants were directed or any other persons, as would best promote the service. Enrollments were to be of those who voluntarily offered themselves. All who enrolled were to sign the following enrollment: "We the subscribers, do hereby enroll ourselves to serve as militia of Maryland in the middle department, that is to say, from this province to New York inclusive, until the first day of December next, unless sooner discharge by the honourable Congress according to the resolution of the Convention of Maryland, held at Annapolis the 21st day of June, 1776"

The order adopted in arranging the Flying Camp Companies is that of the Convention of Maryland in the election of the officers of said companies, 29 June, 1776. After each County's name, the names of the officers of the companies for each County, elected by the Convention, are given.

Frederick Town, July 13th, 1776

Gentlemen:

Capt. Mantz informs me that his Company will be ready to march by the 20th of this Instant if he can be supplied with canteens, camp kettles and a few guns. Therefore I hope you will send up some money by the bearer hereof in order to purchase the guns and canteens for they may be had here for the cash. No camp kettles are to be had here, therefore hope you will give orders concerning them and to what place he is to march and you will greatly oblige

At the request of John Hellen, I have this day Reviewed and Passed twelve able bodied effective men for the Flying Camp. I also Reviewed and Passed, on the 14th Instant, twenty four effective men for the Flying Camp for Ensign Wm. Beatty, Jr., eight of which he requests may be appropriated for Lt. John Hellen's Warrant. Given under my hand this 20th day of July, 1776.
