In the full recognition of the Existence,
the Wisdom and Goodness of the Supreme Ruler of the Universe, I, Paton Wilson
of the Township of Salem in the County of Henry in the State of Iowa, being
in the full possession and use of my faculties of Mind and Understanding but
deeply Sensible of the Uncertain duration of life and the inevitable
Certainty of Death with the View that my Temporal Affairs May be put in
readiness for that Event, so Make, Establish, Publish and Declare This My
Last Will and Testament—hereby revoking, annulling and setting aside all
Prior or former Will or Wills by Me heretofore Made
That is to Say
First It is my full
request wish and desire that all My just debts owing by Me at the time of my
Death together with My burial Expenses be fully and justly paid as soon as
the condition of my estate will possibly admit of its being done.
Second I Will and bequeath
to my daughter Gulielina three hundred dollars and the George Miller Cow, and
then that she is to share and share alike with my other children in the
division of my estate.
Thirdly I will and bequest
to Thomas Snook five hundred dollars in addition to what I have given him
heretofore.
Fourthly I will and bequeath
to my grandson Paton Wilson (son of William Wilson) two hundred dollars and a
silver watch worth thirty dollars.
Fifth I will and bequeath
to my daughter Gulielina, Thomas Snook and my grandson Paton Wilson jointly
the use of my farm for twelve months from and after the first day of March
next.
Sixth I will and bequeath
to my daughter Gulielina and my grandson Paton Wilson the necessary provision
for twelve months from the first day of November last.
Seventh I will and bequeath
to my grandson Paton Wilson (Son of Samuel Wilson) a Silver watch worth
thirty dollars.
Eighth I will and desire
that after my demise all of my personal property may be sold in the way that
my Executor may think most advisable.
Ninth I will and desire
that after the 1st day of March A.D. 1869 my Executor to proceed
to sell all of my Real Estate either all together or in lots as he may think
most advisable and make deeds to the
same as valid as though I had signed them myself.
Tenth I will and desire
that all my children may be made equal in the benefit that I have given them
which is to be determined by a book that I have kept relative thereto and
then that they shall all share and share alike in the remainder of my Estate.
Eleventh I further will and
bequeath that in the event of consummation of a contract or an agreement that
I have made with the Guardian of the heirs of Mary Wilson deceased relative
to some Real Estate formerly held by said deceased, then and in that case I
will and bequeath to Eliza McGilly wife of John McGilly of the County of
Washington and State of Iowa One hundred and fifty dollars.
Twelfth I order and direct
that the disposition of My property be cheerfully acquiesced in by all of the
several beneficiaries of this my will and I order and command and direct that
should anyone named herein or any claiming under the ??? seek
litigation with the view of changing such distribution that from that time
any interest he may have under this will cease and the acquiescing ???.
Thirteenth Finally I do hereby
make constitute and appoint my beloved friend Peter Hobson Executor of my
last will and testament and having full confidence in his integrity and
judgment I hereby Expressly waive his giving bonds for the execution of the
trust hereby imposed upon him and I hereby authorize him in disposing of my
Real Estate to sell the same either at public or private auction as he may
think most advisable and further authorize and desire him to carry out all of
contracts and engagements as fully as I could do if living.
